In a negligence claim arising in Charleston County, a Plaintiff settles a claim for permanent injuries arising from a boat accident on the Cooper River.  The Plaintiff, Sylvester Morton, was fishing from his Jon Boat in the Cooper River in 2012 when a 31 foot center-console Wellcraft driven by a friend of the owner drove over  the Plaintiff’s dingy-type vessel.  The incident resulted in serious injuries, including bruised lungs and broken ribs.  The Insurer of the charter-boat owner creatively resurrected a maritime law from the 1800’s, the Shipowner’s Limitation of Liability Act, in an attempt to limit liability, but failed to prove its application.  The action finally settled after mediation for $735,000.00
